These terms and conditions apply to all vehicle sales made by Appleby Motors, whether conducted in person or online. By proceeding with the purchase, the customer accepts and agrees to the terms set out below.
Definitions
- "Customer" refers to the person or business purchasing the vehicle.
- "Appleby Motors" refers to the seller, Appleby Motors of Unit 11 Elms Business Court, Atherstone Road, Appleby Magna, DE12 7AP.
- "Vehicle" means any car, van, or road-going vehicle sold by Appleby Motors.
1. Warranty & Extended Cover Options Complimentary 30-Day Warranty
All vehicles are sold with a complimentary 30-day limited return-to-base warranty. Should a fault occur, it is the customer's responsibility to return the vehicle to our premises. This includes both drivable returns and vehicle recovery if the car cannot be driven. In all cases, it is solely the customer’s responsibility to arrange and cover the cost of transporting or recovering the vehicle to our location. Appleby Motors does not reimburse recovery or transport costs under any circumstances.
- Warranty Documentation
A warranty booklet and accompanying documentation will be provided to the customer at the point of sale, detailing the specific terms, what is covered, and the claims process.
- Customer Statutory Rights
This warranty does not affect the customer's statutory rights under the Consumer Rights Act 2015. Under this legislation, customers have the right to expect that a vehicle is of satisfactory quality, fit for purpose, and as described at the time of sale. If a fault arises within the first 30 days of ownership, customers may have the right to reject the vehicle and receive a full refund, provided the issue is not related to wear and tear or damage caused post-sale. Beyond this initial period, customers may still be entitled to a repair or partial refund depending on the circumstances.
- Extended Warranty Options
In addition to the complimentary 30-day warranty, we offer extended warranty products through RAC, including Gold and Platinum cover, for either 6 or 12 months. Pricing and full details are available upon request. Where no extended warranty is taken, the customer acknowledges satisfaction with our standard 30-day offering.
2. Part Exchange Terms
All part exchange vehicles are subject to inspection and road test by Appleby Motors. We reserve the right to reappraise and revalue part exchange vehicles if the sale takes place at a later date than the original valuation or if new damage/defects are noted. All part exchanges are valued at trade price, and the customer must have legal ownership and the right to sell the vehicle. Proof of ownership may be requested.
3. Deposits & Inspections
Appleby Motors does not accept holding deposits. Any monies paid toward a vehicle are considered a commitment to purchase and are non-refundable. Customers are encouraged to inspect vehicles on site and may arrange an independent inspection at their own cost, provided this is conducted on-site with prior approval.
4. Finance
We are authorised to act as a credit broker and not a lender. We work with a selection of approved finance providers and may receive a commission from the lender. All finance offers are subject to status and affordability checks. We do not charge fees for finance introductions.
5. Vehicle Inclusions & Service History
It is the customer’s responsibility to confirm what is included with the vehicle (e.g., number of keys, service history, locking wheel nut, handbook, etc.) prior to sale. Inclusions vary from vehicle to vehicle.
6. Vehicle Condition & History
Customers must ensure they are satisfied with the condition of the vehicle prior to purchase. HPI checks are available upon request. Vehicles may have undergone previous repairs or paintwork. Where a vehicle is recorded as Category N or S, this will be disclosed before sale. No guarantees regarding vehicle history are made unless provided in writing.
7. Pre-Delivery Inspection & MOT
All vehicles undergo a pre-delivery inspection. Where required, a new MOT will be completed to ensure roadworthiness (minimum 6 months). All vehicles will be supplied with tyres having a minimum tread depth of 2.5mm unless otherwise agreed in writing.
8. Administration, Insurance & Tax
We do not charge any administration fees. Appleby Motors does not provide drive-away insurance. Customers must ensure the vehicle is fully insured before leaving the premises. We can assist with the taxation process at the point of collection, but responsibility for road tax and insurance remains with the customer.
9. Test Drives
Test drives are available by request and subject to staff availability. Customers must present a valid UK driving licence prior to a test drive. Appleby Motors provides insurance cover for all test drives—customers are not required to provide their own insurance. We reserve the right to refuse a test drive at our discretion.
10. Export and Trade Sales
Vehicles sold for export or trade purposes—including those advertised as spares or repairs— are sold strictly as seen. No warranties, guarantees, or assurances are provided on such vehicles. These sales are final and are not covered by standard consumer protection laws.
11. Distance Sales Distance Sale – Your Right to Cancel

If you buy as a consumer and the Consumer Contracts Regulations 2013 apply, you will have the right to cancel this contract within 14 days subject to the below.
The cancellation period will expire after 14 days from the day on which you, or a third party on your behalf, collect or take delivery of your vehicle.
To exercise the right to cancel, you must inform us of your decision to cancel this contract by a clear statement sent by post or email to our address. If required, you can request a template cancellation notice from us but it is not obligatory to use this specific template.
To meet the cancellation deadline, it is sufficient for you to send your clear statement or form confirming your exercise of the right to cancel before the cancellation period has expired.
Effects of Cancellation
If you cancel this contract, we will reimburse to you payments received from you, including the cost of delivering the goods to you (except for the supplementary costs arising if you chose delivery over collection or a type of delivery other than the least expensive type of standard delivery offered by us). This reimbursement is subject to the following conditions:
- We may make a deduction from the reimbursement for loss in value of any goods supplied if the loss is the result of unnecessary handling by you. Anything over and above a standard test drive will be considered unnecessary handling and will lead to a deduction of £1 for each mile driven over 20 miles.
- Cancellation of the sale will incur a restocking & valeting fee of £200 deductible from your reimbursement.
- We may also make deductions for any damage or excess wear.
- We will make the reimbursement without undue delay, and not later than 14 days after the day we receive back from you the vehicle and all documents which were supplied including, but not limited to, service histories and the V5 documentation.
- We reserve the right to register the vehicle with the DVLA only on expiry of your 14-day cancellation period.
- We will make the reimbursement using the same means of payment as used in the original transaction, unless you have expressly agreed otherwise. This may include handing back any part exchange vehicle if still available and/or seeking payment from you to cover any negative equity.
- We will withhold reimbursement until we have received the goods and all paperwork back in good order.
- It is your responsibility to return the vehicle without undue delay and no later than 14 days from the date you notify us of cancellation. The vehicle must not be driven from that point onward, other than to return it.
- You remain liable for the vehicle and any associated tax, insurance, fines, charges, or penalties until it has been accepted back to our premises.
- You must bear the direct cost and responsibility for the safe return of the vehicle.
- You are only liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the vehicle.12.
Mileage Disclaimer
Mileage displayed on the vehicle or advertised is believed to be accurate at the time of sale. However, unless explicitly stated otherwise in writing, Appleby Motors does not guarantee mileage accuracy due to the nature of used vehicles and the potential for previous odometer changes.
12. Data Protection
Appleby Motors complies with all relevant data protection legislation, including the General Data Protection Regulation (GDPR). Customer data will be used solely for the purposes of processing a sale, warranty, finance applications, or other legitimate business interests. We do not share personal data with third parties without consent, except where required for contractual, legal, or regulatory purposes.
13. Reservation of Title
Ownership of the vehicle shall not pass to the customer until full payment of the purchase price has been received by Appleby Motors. Until that time, we reserve the right to repossess the vehicle if payment is not completed as agreed.
14. Typographical Errors Disclaimer
Whilst every effort is made to ensure accuracy, Appleby Motors is not liable for any typographical errors or inaccuracies in vehicle descriptions, pricing, or specifications. It is the customer’s responsibility to verify all details prior to purchase.
15. Force Majeure
Appleby Motors shall not be liable for any failure or delay in fulfilling its obligations due to circumstances beyond its reasonable control. These include, but are not limited to, acts of God, natural disasters, strikes, pandemics, fuel shortages, or government restrictions.
16. Governing Law
These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the English courts.
